SCOPE OF THIS POLICY 

In this Privacy Policy, Biller Genie (“Biller Genie,” “we”, “us”, “our”) explains how and why we collect, use, retain and share the personal information of individuals (“you” or “your”) including: 

  • Visitors to our website at https://www.billergenie.com (“Website”);
  • Our merchant customers (“merchants”) who use the products and services for merchants that are available at our Website (“Merchant Services”); and 
  • Individuals whose personal information we process when they use the customer portal we host on behalf of participating merchants (“Customer Portal”).

The term "personal information" as used in this Privacy Policy refers to: (1) information that identifies you directly such as your name, street and e‑mail address, phone number, and payment card information; and (2) information that may be identified with you indirectly when associated with other information such as your device IP address, device ID, and data from cookie and similar internet technologies.

The term “Services” refers, collectively, to our Website, Merchant Services and Customer Portal.

This Privacy Policy does not cover the privacy policies or practices of any third parties or their services, including third-party websites and platforms that you use to connect with our Services.

YOUR CONSENT TO OUR PRIVACY POLICY

Please read this Privacy Policy carefully before registering for or using our Services.By accessing or using our Services, you signify to us that you agree with the practices described in this Privacy Policy including how we use and disclose your personal information and the choices you have about accessing, updating and correcting this information.If you do not want your personal information used or disclosed in the manner described in this Privacy Policy, then you should not use our Services or Website.

PERSONAL INFORMATION IS PROCESSED IN THE UNITED STATES

Biller Genie is located in the United States and is subject to the information and consumer protection laws of the United States and its individual states as applicable. If you reside or are located in a different country, the data protection laws of that country may differ as to how and what categories of personal information are protected by law and your individual rights with respect to your personal information.We want you to understand that when you provide your personal information to us, or we obtain it through our Services, third parties, or other means, your information will be processed in the United States, in accordance with United States laws, and as explained in this Privacy Policy.See the section of this Privacy Policy titled “INFORMATION FOR OUR INTERNATIONAL USERS.”

WHAT PERSONAL INFORMATION DO WE COLLECT?

Information Submitted by Visitors to Our Website. If you use our Website to schedule a demonstration, sign up for Merchant Services, use the chat feature, subscribe to our blog, or complete a survey, we will ask you to submit the information needed to fulfill your request, which may include your name, email address, telephone number, and additional information depending on your specific Website activity.

Merchant Information Submitted to Register for and Administer Merchant Services.If you are a merchant and register to use our Merchant Services, we will request the information applicable to the Merchant Services you select. This will include personal information if you are an individual merchant or the employee of a merchant. To open an account, we will ask you to select a user name and password, and to submit your name, email address, postal address, telephone number, information pertaining to your business, billing and payment information such as a bank account and credit card information, and other information to establish your identity and credit. When you use our Merchant Services, we will have access to your customers’ transaction and payment activities and will process customer information in accordance with the Biller Genie Merchant License Agreement, which is available on our Website.

Customer Information Processed Using a Customer Portal.If you choose to create an account with a participating merchant using our Customer Portal, we will process your personal information on behalf of the merchant including your name, billing & shipping addresses, credit card and other payment details, email address, phone number, products and services ordered and purchased, charges and other invoice information about your merchant transactions, and your transaction, billing and payment history. The credit card or other payment information you submit will be transmitted directly to a third-party payment processor and Biller-Genie does not have access to that information. 

Information Collected Using Internet Technologies.We and third parties we authorize use cookies and other tracking technologies when you visit our Website, logon to our Merchant Services, or use a Customer Portal. These technologies collect data such as Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and clickstream data. These data may be combined or associated with other information to be identifiable to you. See the section of this Privacy Policy titled “WHAT DATA ARE COLLECTED USING COOKIES AND TRACKING TECHNOLOGIES?”

Information from Other Sources.Biller Genie may obtain contact leads and demographic information (for example, age, sex, household income, employment) from affiliated companies, including Sales Genie and Info Group), and marketing and data analytics resources. We also obtain personal information from e‑mail and other direct communications with you

HOW DO WE USE PERSONAL INFORMATION?

We use personal information for the purposes identified below. Our use of personal information is subject to this Privacy Policy, specific terms applicable to the Services or actions you request (including the Biller Genie License and Merchant Agreement); your options where available, and applicable law.

Establish and Administer Merchant Services.We use personal information to:

  • Confirm, process, communicate about, and fulfill requests you submit to us;
  • Establish, administer, and maintain your Merchant Services account if you sign up with us; 
  • Verify your identity and authenticate your access to your account; and
  • Issue invoices and tax documents for Merchant Services (as required by law) and process payments.

Establish and administer Customer Portal accounts.We use personal information to:

  • Establish, administer, and maintain the Customer      Portal account you set up through a participating merchant; 
  • Authenticate your access to your Customer      Portal account. 

Management of Website and Services.We use personal information to manage, operate, and enhance the functionality of the Website and Services (including the provision of functions which require identifiers or other personal information).

Direct Marketing.To further our legitimate interest in marketing to users of both our Merchant Services and our Customer Portal, we use the personal information you submit and that we collect from your use of our Services to:

  • Provide you with promotional materials about      our Services; and
  • Send you e-mails, digital newsletters,      personalized offers or other communications about our products and      services. You are able to unsubscribe to these communications at any time      by clicking “unsubscribe” in an email and/or contacting us as explained in      the section titled “HOW TO CONTACT US” below. 

HOW AND WHY WE DISCLOSE PERSONAL INFORMATION AND OTHER DATA TO THIRD PARTIES

Service Providers.We share your personal information with third-party service providers who support our business operations. These include: payment processing; hosted services such as data storage; technology support services; e-mail marketing services; e-commerce contact management services; and maintenance and security. We take commercially reasonable measures to select service providers who agree to protect the personal information we entrust to them and who maintain privacy guidelines that are consistent with our Privacy Policy. 

Website Analytics.When you use our Website and Services, website and marketing analytics companies we authorize, including Google Analytics and HubSpot, collect information about you and your online activities by. These third parties provide statistical reports to us about usage of our Website and visitor demographics. Online and Social Media Advertising. We may engage third party ad servicers to display our advertising on other websites, social media platforms, and mobile applications and to display other companies’ advertising on our Website. These ad servicers use cookies to gather information about visitors’ activities using our Website as well as other websites and mobile applications to serve internet advertising based upon your browsing activities and interests. Marketing Partners and Affiliated CompaniesWe share your personal information with our affiliated companies for marketing and service optimization and with other businesses with which we contract. These businesses may contact you as part of a joint or separate marketing or promotional program. 

Compliance with Laws and Legal Process.To comply with applicable laws, we may disclose your personal information to third parties in response to a court order or subpoena. In addition, we may disclose your personal information, without notice to you, to government agencies and in response to lawfully issued requests.

Protection of Our Services.We may disclose your personal information to third parties to protect our rights and properties, or protect the rights and properties of the users of our Services.For these purposes, we may disclose personal information to government agents, including law enforcement, private companies assisting with fraud protection or investigation, and our professional advisors.

Business Transactions.Nothing in this Privacy Policy is intended to restrict our ability to engage in a business transaction for any lawful purpose without notice or compensation to you, unless required under applicable law, such as a financing, reorganization, merger, or a sale or transfer of all or part of our business, equity, or assets. To prepare for or undertake such a transaction, we may disclose personal information to the transaction’s parties and their advisors if we have a legitimate interest in doing so and subject to appropriate confidentiality protections.

WHAT DATA ARE COLLECTED USING COOKIES AND TRACKING TECHNOLOGIES?

We and third-party service providers place cookies, tags, and other internet tracking technologies on the web browser of our Website visitors and Services users to collect data about them and their online activities.The data collected using cookies and similar technologies include: 

  • Identification – user name and password if you establish a      Merchant Services or Customer Portal account, date and time of each visit,      history of visits, and other personalized services including event      registrations;
  • Device – your IP address, internet domain name, internet service provider,      browser type, operating system, mobile network, device telephone number; 
  • Usage – referring site or application, content viewed on our Website and      time spent in viewing each file, number and duration of visits and history      of the Website pages viewed, and other internet activities; and
  • Location – your      general geographic location can be determined by your IP address and a      more specific location is available if you access our Website or Services      using a mobile device unless blocked. 

We use data collected using cookies and internet tracking technologies for:

  • Website and Marketing Analytics:
  • Analyze usage of our Services and Website, the number of visits (including via IP address logging) from different locations, and your online browsing activities so that we better understand the interests and demographics of our users and visitors and improve performance and effectiveness;
  • Monitor and control the use of our Services and Website for security purposes; and
  • Compile, aggregate, and analyze data on a de-identified basis about usage of our Services and Website (note that de-identified data are not subject to this Privacy Policy).
  • Online Advertising. Third-party advertising service providers, such as Google Ads and      Capterra, use data collected from cookies and other internet technologies      to provide retargeted advertising to Website visitors when they visit      other companies’ websites. 

We do not disclose personal information to Website analytics and ad service providers. However, these third-parties may monitor the use of the Website by the user and combine this data with data from other websites monitored by the same service provider which the user has visited and the servicer may use these findings for its own business purposes and may be able to identify the visitor from other sources.

HOW YOU CAN RESTRICT TRACKING TECHNOLOGIES AND PERSONALIZED ADVERTISING 

There are browser and other controls you can use to restrict how these technologies are used to track and log your information and online activities in order to collect web usage data and personalize the advertisements served to you on our Website and third-party websites. These controls include:

If you restrict the use of cookies and other technologies, some of our website services cannot be fully utilized.If you chose to restrict personalized advertising, you will still receive ads, but they will not be personalized.

Do Not Track (DNT) is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third-parties.We do not respond to DNT signals.

HOW LONG DO WE RETAIN PERSONAL INFORMATION?

We will retain your information for as long as your account is active or as needed to provide you with access to our Merchant Services or Customer Portal, as applicable. In addition, we will retain and use your contact information for our legitimate marketing and record-keeping purposes and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. 

HOW DO WE PROTECT PERSONAL INFORMATION?

We use technical, organizational, and physical security measures to meet the standards of this Privacy Policy. Although we make reasonable efforts to protect your personal information from unauthorized access, use or alteration, we cannot and do not guarantee the security of your information and there is always a risk inherent in the electronic communication of information (including without limitation from unauthorized entry or use, telecommunication issues, hardware or software failure, human error, and other factors). Biller Genie does not process credit card transactions and credit card information is encrypted and processed by an industry-certified payment card processor.

You are responsible for choosing a secure Login ID/password when you set up an account to use Merchant Services or a Customer Portal.You should keep this password confidential and you should choose a password that you do not use on any other online account.You should not share your password with anyone, including anyone who claims to work for us.You should change your password from time to time to help protect your account.You should also protect your computer and mobile devices against unauthorized access. 

LINKS TO THIRD-PARTY SITES AND SOCIAL MEDIA PLATFORMS

This Privacy Policy applies only to personal information collected by Biller Genie.Our Website may provide links to third-party content, websites, social media networks, applications, applications and other services ("Third-Party Sites").Biller Genie also maintains an online presence on and plug-ins for social media platforms, including Facebook.com, Instagram, and Twitter (“Social Media Platforms”) and maintains interactive mini-programs with these Social Media Platforms.When you interact with these Social Media features including “Liking” our pages, sending us direct messages, activating a plug-in, or submitting other information, the Social Media Platforms may collect your IP address, which page you are visiting on our Website, may place their own cookies or other files on your computer, collect data or solicit personal information from you. 

Biller Genie has no control over the privacy practices, content, or method of collecting information by Third-Party Sites or Social Media Platforms.Your personal information is subject to the data practices of these services.We do not guarantee their accuracy, completeness, legality, or any other aspect.We recommend that you check the applicable privacy policy and settings of the Third-Party Sites and Social Media Platforms.

If Biller Genie receives and retains information about you from a Social Medial Platform or Third-Party Sites, we provide that data with the protections outlined in this Privacy Policy.

INFORMATION FOR OUR INTERNATIONAL USERS

Processing Takes Place in United States.Biller Genie is based in the United States and follows the information and consumer protection laws of the United States and its individual states.Personal Information that originates outside the United States will be transferred to, stored in, and processed in the United States, although we may from time to time use data processing and storage vendors in other countries or territories. 

If you are the customer of a participating merchant, that merchant is the controller with respect to your personal data. Biller Genie will process your personal information as necessary to provide the Customer Portal in accordance with the contract between Biller Genie and the participating merchant, to contact you for legitimate marketing purposes (and from which you can unsubscribe at any time), and as further provided in this Privacy Policy.You need to contact the participating merchant with requests and questions about your personal data processed using the Customer Portal.

CALIFORNIA PRIVACY RIGHTS

California residents who provide customer information in obtaining products or services for personal, family or household use are entitled to request and obtain from us, once per calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year. To obtain this information, please send an email message to [email protected] with "Request for California Privacy Information" on the subject line and in the body of your message. We will provide the requested information to you at your e-mail address in response. Note that only information on information sharing subject to the law (if any) will be included in our response

CHILDREN’S INFORMATION

Our Services are available only to individuals who are legally able to use them. We do not knowingly collect personal information from a child under the age of thirteen or other age at which collection of personal information is prohibited by law. We will promptly delete the personal information we inadvertently obtained from an underage child if notified by a parent or guardian or we otherwise receive actual knowledge that we have such information.
